Welcome to TradeGEX. By accessing or using our platform, you agree to be bound by these Terms of Service. Please read them carefully.

1. Acceptance of Terms

By creating an account or using TradeGEX, you agree to these Terms of Service, our Privacy Policy, and our Risk Disclosure. If you do not agree, you may not use our services.

2. Description of Service

TradeGEX is a data visualization and market analysis tool that displays options flow data, gamma exposure (GEX), Hedge Flow™, and related market indicators for futures trading. Our service is designed for informational and educational purposes only.

    Important: TradeGEX is NOT a trading signal service, investment advisor, or broker. We do not execute trades, manage accounts, or provide personalized investment advice. All trading decisions are made solely by you.
  

3. Service Availability and Operating Hours

TradeGEX is designed to provide real-time options flow data and market analysis during the New York trading session (Regular Trading Hours), typically 9:30 AM to 4:00 PM Eastern Time on regular market days.

    Data Availability Notice: Our options data feeds, including gamma exposure (GEX), delta exposure (DEX), Hedge Flow™, and Greek calculations, are dependent on third-party market data providers. These data feeds are primarily available during Regular Trading Hours (RTH) when the options markets are actively trading and publishing real-time data.
  

Outside Regular Trading Hours:

Options data feeds may be unavailable, delayed, or display stale information from the previous session
GEX levels, walls, and other calculated indicators may not update in real-time
The platform may display price movements from futures markets while options-derived data remains static
Pre-market and after-hours periods are not guaranteed to have full data availability

Maintenance Windows: We may perform system maintenance, updates, and platform improvements during off-market hours, including pre-market, after-hours, overnight, and weekends. During these periods:

The platform may be temporarily unavailable or operate in a limited capacity
Data displayed may be for testing purposes and not reflect actual market conditions
Features may be added, modified, or temporarily disabled without prior notice

No Guarantee of Extended Hours Service: If the platform appears to function or display data outside of Regular Trading Hours, this does not constitute a guarantee or commitment that such service will always be available. Extended hours functionality, when available, is provided on an "as-is" basis without any service level commitments.

4. Service Interruptions and Technical Limitations

TradeGEX relies on complex technology infrastructure including data feeds, servers, internet connectivity, and third-party services. Despite our best efforts to maintain robust and reliable systems, you acknowledge that:

    Service Continuity Notice: While we invest in professional-grade equipment and infrastructure, TradeGEX cannot guarantee uninterrupted service. Technical failures, data feed interruptions, and service outages may occur without warning and are inherent risks of any technology-based platform.
  

Factors That May Affect Service:

Data Feed Interruptions: Our third-party data providers may experience outages, delays, or transmission errors that affect the accuracy and availability of market data
Internet Connectivity: Your internet connection or our network infrastructure may experience disruptions affecting platform access
Power Outages: Electrical failures at data centers, server facilities, or your location may interrupt service
Server Issues: Hardware failures, software bugs, or capacity limitations may cause temporary service degradation or outages
Third-Party Dependencies: Services we rely on (cloud providers, CDNs, authentication services) may experience their own technical difficulties
Cybersecurity Events: DDoS attacks, security incidents, or required emergency maintenance may necessitate service interruptions
Force Majeure: Natural disasters, extreme weather, civil unrest, or other events beyond our control may affect service availability

No Liability for Interruptions: TradeGEX shall not be held liable for any losses, damages, or missed trading opportunities resulting from service interruptions, regardless of the cause. You are strongly advised to:

Not rely solely on TradeGEX for time-critical trading decisions
Maintain alternative sources of market data and analysis
Have backup internet connectivity when trading
Use proper risk management including stop-loss orders with your broker
Never enter positions you cannot monitor or manage independently

No Service Level Agreement: TradeGEX does not offer any service level agreement (SLA) or uptime guarantee. We do not provide compensation, credits, or refunds for service interruptions or outages of any duration.

5. Data Accuracy and Limitations

While we strive to provide accurate and timely information, you acknowledge that:

Market data is sourced from third-party providers and may contain errors, delays, or inaccuracies
Options data and derived calculations (GEX, DEX, Greeks) are estimates based on available market information
Data refresh rates may vary depending on market conditions and provider availability
Historical data may be adjusted, corrected, or restated without notice
System outages, data feed interruptions, or technical issues may occur without warning
We do not guarantee the accuracy, completeness, timeliness, or reliability of any data displayed

    Software Bugs and Defects: TradeGEX is a complex software platform under continuous development. Despite rigorous testing and quality assurance efforts, you acknowledge and accept that software bugs, defects, errors, and unexpected behavior may occur at any time without warning. These may include, but are not limited to:
  

Incorrect calculation or display of GEX levels, walls, delta exposure, Hedge Flow™, Greeks, or any other derived indicators
Visual rendering errors in charts, graphs, heatmaps, or other data visualizations
Delayed, duplicated, missing, or out-of-sequence data points
Incorrect price levels, strike prices, volume figures, or open interest values
Features or indicators behaving differently than documented or expected
Errors introduced during platform updates, new feature deployments, or maintenance
Inconsistencies between different views, timeframes, or components of the platform
Memory leaks, performance degradation, or interface freezes during extended sessions

TradeGEX shall not be held liable for any trading losses, missed opportunities, or financial damages resulting from software bugs, calculation errors, display glitches, or any other platform defect, regardless of whether such defect was known or unknown, reported or unreported. You expressly waive any claim against TradeGEX arising from reliance on data or indicators that were affected by software errors.

    Your Responsibility: You are solely responsible for verifying any information before making trading decisions. Never rely solely on TradeGEX data without independent verification from your broker or other authoritative sources.
  

6. User Responsibilities

As a user, you agree to:

Provide accurate information when creating your account
Maintain the confidentiality of your login credentials
Use the platform only for lawful purposes
Not share your account with others or allow multiple simultaneous sessions
Not attempt to reverse engineer, copy, or redistribute our platform or data
Not use automated systems to access the platform without permission
Accept full responsibility for your own trading decisions
Understand the operating hours and data limitations described in these terms
Not hold TradeGEX liable for any decisions made based on data displayed on the platform at any time, including but not limited to Regular Trading Hours, pre-market, after-hours, and weekend periods

Data Collection Acknowledgment: By using TradeGEX, you acknowledge and consent to the collection of usage and presence data as described in our Privacy Policy. This includes, but is not limited to, your online presence status, symbols and charts in use, session timestamps, approximate geographic location, and platform interaction patterns. This data is collected for platform optimization, statistical analysis, account security, and service reliability purposes.

7. Subscription and Billing

TradeGEX operates on a subscription basis. By subscribing, you agree that:

Subscription fees are billed monthly in advance
Subscriptions automatically renew unless cancelled before the renewal date
When you cancel, your subscription remains active until the end of the current billing period
No prorated refunds are issued for unused time within a billing period
No refunds are provided for service interruptions, maintenance periods, or data feed outages
Refunds are provided at our sole discretion and only in exceptional circumstances
We reserve the right to modify pricing with 30 days notice to existing subscribers
All future updates and features are included at no additional cost during your subscription

    Automatic Renewal Disclosure: Your subscription will automatically renew at the end of each billing cycle at the then-current rate unless you cancel before the renewal date. You may cancel at any time through your account settings or by contacting support@tradegex.pro. Cancellation takes effect at the end of the current billing period. By subscribing, you expressly consent to recurring charges on your payment method until you cancel.
  

Payment Processing:

All payment transactions are processed securely by Stripe, Inc., our third-party payment processor. TradeGEX does not store, process, or have direct access to your full credit card number, debit card number, or bank account details. Your payment information is handled entirely by Stripe in accordance with PCI DSS (Payment Card Industry Data Security Standard) compliance requirements. By subscribing, you also agree to Stripe's Services Agreement and Privacy Policy as they apply to the processing of your payments.

Price Changes:

We reserve the right to modify subscription pricing at any time. Existing subscribers will receive at least 30 days advance notice of any price change via email to the address associated with their account. If you do not agree with the new pricing, you may cancel your subscription before the next billing cycle. Continued use of the platform after the price change takes effect constitutes acceptance of the new pricing. It is your responsibility to maintain a current and valid email address in your account settings.

Payment Disputes and Chargebacks:

    Important: You agree to contact TradeGEX directly at support@tradegex.pro to resolve any billing disputes before initiating a chargeback, payment reversal, or dispute with your bank or credit card company. We commit to responding to billing inquiries within 48 hours.
  

Initiating a chargeback or payment dispute without first attempting to resolve the issue directly with TradeGEX constitutes a violation of these Terms of Service and may result in:

Immediate suspension or permanent termination of your account
Forfeiture of any remaining subscription time
A permanent ban from creating new accounts on the platform
Collection efforts for any amounts owed, including chargeback fees and administrative costs incurred by TradeGEX
Reporting to fraud prevention databases where applicable

TradeGEX reserves the right to dispute any chargeback it considers fraudulent or unjustified and to provide transaction records, usage logs, and acceptance records as evidence to the payment processor and financial institutions involved.

7A. Acceptance of Terms and Consent Records

By creating an account and subscribing to TradeGEX, you acknowledge that:

You have read, understood, and agree to be bound by these Terms of Service, our Privacy Policy, and our Risk Disclosure
You expressly consent to the automatic renewal of your subscription as described in Section 7
Your acceptance is recorded and stored, including the date and time of acceptance, the version of the terms accepted, your IP address, and your account identifier
These acceptance records may be used as evidence in any dispute, chargeback proceeding, or legal matter
It is your responsibility to review the current version of these terms before each renewal period
Continued use of the platform after any modification to these terms constitutes your acceptance of the modified terms

    Record Retention: TradeGEX maintains auditable records of your consent and acceptance of these terms, including automatic renewal authorization, for the duration of your account and for a period of no less than three (3) years following account termination, or as required by applicable law.
  

8. Free Trial

TradeGEX may offer a free trial period to new users. The free trial does not require a payment method and does not automatically convert to a paid subscription. By using a free trial, you agree that:

Free trials are limited to one per person, household, and device
No payment method is required to activate a free trial
At the end of the trial period, your access will expire unless you choose to subscribe
Creating multiple accounts to obtain additional trials is prohibited
We reserve the right to verify your identity and deny trials to users who have previously used the service
Abuse of the trial system may result in permanent ban from the platform
Trial accounts are subject to the same terms and limitations as paid subscriptions regarding data accuracy, service availability, and liability

    Trial Abuse: TradeGEX actively monitors for trial abuse through device fingerprinting, IP tracking, email verification, and other fraud detection methods. If we determine, at our sole discretion, that you have created multiple accounts, used fraudulent information, or otherwise abused the trial system, we reserve the right to: immediately terminate all associated accounts, deny future access to the platform, and pursue any additional remedies available under law.
  

9. Account Termination

We reserve the right to suspend or terminate your account immediately and without notice if you:

Violate these Terms of Service
Share or resell access to your account
Create multiple accounts or abuse the trial system
Attempt to manipulate or abuse the platform
Use the platform for illegal activities
Engage in fraudulent payment activities including chargebacks without prior direct resolution attempt (see Section 7)
Reverse engineer or copy our proprietary data or algorithms
Harass, threaten, or abuse TradeGEX staff or other users
Attempt to interfere with the platform's operation or security

Upon termination, your access will be immediately revoked. No refunds will be provided for accounts terminated due to policy violations.

10. Intellectual Property

Proprietary Technology: The TradeGEX platform, including but not limited to its software, algorithms, data processing methods, visualizations, indicators (including Hedge Flow™), user interface designs, and documentation are proprietary and protected by copyright, trade secret, and other intellectual property laws.

Educational Content: All content in TradeGEX Academy and other educational materials is original work protected by copyright. While we discuss publicly known concepts in options theory and market mechanics, our specific methodologies, analytical frameworks, and implementations are proprietary.

Prohibited Activities: You may not, without express written permission from TradeGEX:

Copy, reproduce, or distribute any part of the platform or its content
Reverse engineer, decompile, or disassemble the software or algorithms
Create derivative works based on the platform or its content
Use automated tools to scrape, extract, or collect data from the platform
Resell, sublicense, or commercially exploit any aspect of the service
Remove or alter any proprietary notices, labels, or marks
Share screenshots, recordings, or data from the platform publicly without permission

Third-Party Content: Market data displayed on TradeGEX may be sourced from third-party providers. Such data remains the property of its respective owners and is subject to their terms of use.

    Enforcement: We actively monitor for unauthorized use of our intellectual property. Violations may result in immediate account termination without refund, legal action, and claims for damages including attorney fees.
  

11. No Investment Advice

TradeGEX does not provide investment advice, trading recommendations, or signals. The information displayed is for educational and informational purposes only. You should consult with a qualified financial advisor before making any investment decisions. Past performance of any indicator or analysis does not guarantee future results.

12. Assumption of Risk

By using TradeGEX, you expressly acknowledge and agree that:

Trading futures and options involves substantial risk of loss
You may lose more than your initial investment
You are solely responsible for all trading decisions you make
TradeGEX data and analysis should not be the sole basis for any trading decision
Market conditions can change rapidly and data may not reflect current conditions
You have read and understand our Risk Disclosure document
You are trading with capital you can afford to lose

13. Limitation of Liability

To the maximum extent permitted by law:

TradeGEX is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied
We expressly disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement
We do not guarantee the accuracy, completeness, timeliness, or reliability of our data or service
We are not liable for any trading losses, missed opportunities, or financial damages you may incur
We are not liable for any data feed interruptions, outages, or inaccuracies from third-party providers
We are not liable for any indirect, incidental, special, consequential, or punitive damages
We are not liable for any loss of profits, revenue, data, or business opportunities
Our total aggregate liability for any claims is limited to the amount you paid for the service in the 3 months preceding the claim

14. Indemnification

You agree to indemnify, defend, and hold harmless TradeGEX, its operators, officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorney fees) arising from:

Your use of the platform
Your violation of these Terms of Service
Your trading activities and decisions
Any breach of your representations and warranties
Your infringement of any third-party rights

15. Dispute Resolution

Informal Resolution: Before filing any formal legal action, you agree to contact us at support@tradegex.pro and attempt to resolve the dispute informally for at least 30 days.

Binding Arbitration: Any dispute not resolved informally shall be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration shall be conducted in the English language, and the arbitrator's decision shall be final and binding.

Class Action Waiver: You agree to resolve disputes on an individual basis only. You waive any right to participate in a class action, class arbitration, or representative action against TradeGEX.

Small Claims Exception: Either party may bring an individual action in small claims court if the dispute qualifies.

16. Changes to Terms

We may modify these terms at any time. Changes will be effective immediately upon posting to the website. Continued use of the platform after changes constitutes acceptance of the new terms. We will notify users of significant changes via email or platform notification. It is your responsibility to review these terms periodically.

17. Severability

If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms of Service, together with our Privacy Policy and Risk Disclosure, constitute the entire agreement between you and TradeGEX regarding your use of the platform and supersede any prior agreements.

19. Governing Law

These terms are governed by and construed in accordance with the laws of the United States and the State of Florida, without regard to conflict of law principles.

20. Educational Content and TradeGEX Academy

TradeGEX provides educational materials through TradeGEX Academy and other resources. By accessing this content, you acknowledge and agree that:

    Important Disclosure: The information provided in TradeGEX Academy and all educational materials is for educational and informational purposes only. Trading futures and options involves substantial risk of loss and is not suitable for all investors. Past performance is not indicative of future results.
  

Educational Purpose Only:

TradeGEX is a data visualization and analytical tool, not a trading signal service
We do not provide trading signals, investment advice, or personalized recommendations
All trading decisions are made solely by you, the user
The concepts, indicators, and strategies discussed describe market mechanics and probabilities, not guaranteed outcomes
Educational content is intended to help you understand the platform and market concepts, not to predict market movements

Content Accuracy and Updates:

Educational content may contain editorial errors, inaccuracies, or outdated information
Interface elements, colors, features, and functionality described may differ from the actual platform as TradeGEX continues to evolve
Screenshots and examples may not reflect current market conditions or platform appearance
Always refer to the live application for current functionality
We reserve the right to update, modify, or remove educational content at any time without notice

By using TradeGEX and the information in our educational materials, you acknowledge that you understand the risks involved in futures and options trading and accept full responsibility for your trading decisions.
